Information about the transfer of tenancy agreement
(Land Code, Chapter 12, Sections 32–34, 47)
*According to the Swedish Tenancy Act (Land Code, Chapter 12),
a transfer of a tenancy agreement requires a minimum shared residence period of three years.
In case of divorce/separation
In the event of a separation, a spouse or cohabiting partner in a marriage-like relationship
may take over the tenancy agreement if the landlord can reasonably accept them as a tenant
(Land Code, Chapter 12, Section 47, paragraph 2).
If the cohabiting partner moved in later, a shared residence period of at least three years*
(see explanation above) is required.
The application must include a population registration certificate (personbevis) from the
Swedish Tax Agency confirming cohabitation between the current tenant and the person
wishing to take over the contract, as well as documentation proving the separation.
In the case of divorce, the application to the District Court must be attached.
A credit check will be carried out on the person who is to take over the apartment.
Any dispute between the parties regarding who should retain the apartment
will be decided by the District Court.
Transfer to a close relative
The tenancy agreement may also be transferred to a close relative, such as a parent or child,
provided that a joint household has existed for at least three years* (see explanation above).
Cohabitation must be verified by attaching population registration certificates from the
Swedish Tax Agency for both the current tenant and the person wishing to take over the tenancy.
A credit check will be carried out on the person who is to take over the apartment.
The new tenant must be approved by AB Bostaden according to the same policy
that applies to new tenants.
In the event of death
In the event of death, a spouse or cohabiting partner has the right to take over the
tenancy agreement if the dwelling has been used jointly.
The application must include a “death certificate with family investigation”
(dödsfallsintyg med släktutredning).
For transfers to a cohabiting partner, a population registration certificate from the
Swedish Tax Agency confirming cohabitation between the deceased tenant and
the person wishing to take over must also be attached.
A credit check will be carried out on the person who is to take over the apartment.
Student apartments
For students renting student apartments, the above rules also apply.
However, the person wishing to take over the agreement must also include a
certificate confirming ongoing studies at Umeå University or the
Swedish University of Agricultural Sciences in Umeå, corresponding to at least 22.5 university credits.
Transfer of tenancy agreements does not apply to single rooms,
as that type of accommodation is intended for one person only.
