How evidence packages can make or break your case

Scrive’s evidence package set a new standard when we first established it and since then it has been one of our key differentiators on the market. It captures the identity of the signing parties, the intent to sign and ensures the integrity of the signed document but it goes even further than this.

To illustrate this in proper detail, let’s compare this to a paper based process.

Imagine you’ve just mailed an agreement in an envelope. How do you know it’s on its way? How do you know who went to the mailbox to pick it up? Do you have any way to confirm the recipient read it? 

Even if the agreement makes it back to you, it’s impossible to be 100% certain that everything was done above board and that the signatory not only signed but that they, in fact, read the full document before signing.

So in the case of replacing paper processes, we can’t simply aspire to be as good, we need to be 100 times better and a part of this is the evidence package logging all of the elements above but also a clear audit trail for the entire process. 

What this means is that not only can you see who signed, that they had the opportunity to read the entire document and that the document has not been tampered with, but also what device they signed on and even, in the case of phones, what orientation the phone was in (landscape/portrait). 

While these may seem like more facets than will be needed in 99% of cases, when it comes to court proceedings, there’s no such thing as proof; only evidence. And the more evidence you have, the better your case.
